1. Introduction & Acceptance of Terms

Welcome to Shipping Container Lifestyle. These Terms and Conditions ("Terms") govern all sales, purchases, quotes, deliveries, and services provided by Shipping Container Lifestyle we via our website, Google Merchant Center listings, or direct sales.

By accessing our website, requesting a quotation, placing an order, or making a payment for shipping containers, modified containers, forklifts, or trailers, you agree to be bound by these Terms in full.

2. Product Specifications & Modifications

A. Shipping Containers & Custom Modifications

  • Condition: We sell both new (one-trip) and used (cargo-worthy / wind and watertight) shipping containers. Unless specified as brand new, used containers may show cosmetic wear, minor dents, rust, or repainted sections that do not compromise structural integrity.

  • Modified Containers: Custom modifications (e.g., doors, windows, insulation, electrical fit-outs, structural alterations) are executed according to the final design specifications and floor plan approved in writing by the Client prior to fabrication. Any changes requested after work has commenced may incur additional charges and cause delivery delays.

B. Forklifts & Trailers

  • Inspection & Condition: Forklifts and trailers are sold either as new or used, as explicitly described in the quote or product listing. It is the Client’s responsibility to review all provided technical specifications, capacities, and condition reports prior to purchase.

  • Roadworthiness & Licensing: Unless explicitly stated, trailers are supplied with standard manufacturer documentation for registration. The Client is responsible for road licensing, registration, and ongoing safety compliance in their local jurisdiction once delivered.

3. Pricing, Quotations & Payment Terms

  • Currency: All prices quoted or displayed are in South African Rand (ZAR) unless otherwise stated.

  • Quotations: Quotes are valid for the period specified on the quotation document (typically 7 to 14 days) due to market fluctuations in steel and transport costs.

  • Payment Terms:

    • Standard Products: Full payment is required upon order placement before goods are dispatched or released for transport.

    • Custom Modifications: A minimum deposit (typically 50%) is required to begin fabrication, with the remaining balance due in full prior to dispatch.

  • Payment Processing: Payments are accepted via approved bank EFT or secure third-party payment gateways. Orders will only be processed or dispatched once funds reflect as cleared in our account.

4. Delivery & Offloading Terms

  • Delivery of heavy industrial equipment (containers, forklifts, and trailers) involves specific site requirements:

  • A. Delivery Access & Site Preparation

  • The Client is solely responsible for ensuring the delivery site has clear, unobstructed, and safe access for heavy haulage vehicles (e.g., side-loaders, flatbeds, or crane trucks).

  • Access roads, driveways, turn-around points, and ground conditions must be firm, level, and capable of supporting heavy vehicle weight.

  • B. Offloading & Crane Services

  • Standard Delivery: Unless crane or hiab offloading is specifically included in your written quote, delivery is on a transport-only basis, and the Client is responsible for providing suitable offloading equipment (e.g., forklift, mobile crane) at the destination.

  • Failed / Delayed Deliveries: If a delivery cannot be completed due to inadequate site access, unsafe ground conditions, client absence, or improper offloading equipment, the Client will be responsible for re-delivery fees, demurrage/holding charges, and return transport costs.

C. Transfer of Risk

  • Risk of loss or damage to the goods transfers to the Client immediately upon delivery to the specified address or upon loading onto a third-party transporter arranged by the Client.

5. Cancellations, Returns & Refunds

  • Standard / Unmodified Products: Return or cancellation requests for standard, unmodified containers, trailers, or forklifts must be submitted in writing within 14 days of receipt. Products must be unused and in their original delivered condition. The Client is responsible for all return freight charges and a restocking fee of up to 15%.

  • Custom Modified Containers: Custom modified orders are non-refundable once fabrication or modification work has commenced, as these items are tailor-made to Client specifications.

  • Defective or Damaged Goods: If equipment arrives damaged or fails to match agreed specifications, the Client must report the issue in writing with photographic proof within 48 hours of delivery.

6. Warranties & Limitation of Liability

  • Manufacturer Warranties: New trailers, forklifts, or modification materials carry standard manufacturer warranties where applicable.

  • Used Equipment: Used shipping containers, trailers, and forklifts are sold "as-is" with guarantees covering structural integrity and wind/watertight condition at the time of delivery, unless an extended warranty is agreed upon in writing.

  • Limitation of Liability: To the maximum extent permitted by law, Shipping Container Lifestyle shall not be liable for any indirect, consequential, incidental, or special damages (including loss of profits, site downtime, or operational disruption) arising out of or in connection with the purchase, delivery, use, or delay of any product.

7. Governing Law & Jurisdiction

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or related to these Terms or purchases made from Shipping Container Lifestyle shall be subject to the exclusive jurisdiction of the courts of South Africa.
